FIDIC has released the much-anticipated new editions of the so-called ‘Red’, ‘Yellow’ and ‘Silver’ books at the FIDIC International Contract User’s Conference, which took place in London on the 5-6 December 2017.

While the industry’s reaction to the new contracts remains to be seen, it is anticipated companies will be quick to use the 2017 editions of these contracts.

ABOUT THE TRAINER

Coenraad Snyman is an affiliate member of FIDIC and is acknowledged as a leading trainer and an experienced practitioner with a hugely impressive track record in contract procurement, contract & claims management and dispute resolution, covering the engineering, mining and oil & gas sectors. Coenraad holds a Degree in Air and Space Law from McGill University, a LLB and BPproc from the University of South Africa and a BA from the University of Cape Town.

Possessing an exceptional understanding of construction and engineering contracts, his past experience includes appointments as a mediator and arbitrator, as well as representing Contractors and Employers in a variety of wide-ranging and complex disputes. Coenraad delivers both bespoke, in-house and public training courses covering the FIDIC and NEC suite of contracts, claims, claims management and dispute resolution.

COMMENT ON FIDIC BY COENRAAD SNYMAN

It is well known that certain provisions within FIDIC were problematic. One only needs to think of the series of Persero cases in Singapore that dragged on for more than eight years in connection with the interpretation and meaning of certain provisions found within the 1999 ‘rainbow suite’.

Whilst the 2008 Gold Book has already introduced a number of improvements to the 1999 ‘rainbow suite’, it did not go far enough. Many issues in practice still needed to be resolved.

Therefore, especially welcome are the changes to procedures pertaining contract administration, as well as changes that relate to and expand upon the role, powers and function of the Engineer’s or Employer’s representative. Failure to properly administer the contract is still the number one reason for most disputes. We believe that these changes will, therefore, go a long way towards reducing the high incidence of disputes.

Similarly, many changes that appear in the new editions relate to the contractual provisions dealing not only with the resolution of disputes, but also with the avoidance of disputes.
