COURSE OVERVIEW

The Construction Act amendments have now been with us for over five years. Whilst the expected “smash and grab” approach to adjudication continues to be prevalent, the courts have over the years intervened and where necessary had their say on the limitations of payment notices and/or pay less notices. As a consequence, where does this leave us now and how do we ensure current payment practice doesn’t fall foul of the Act?

In this interactive session HKA will review recent case law and summarise the guidance provided by the courts in relation to payment notices. HKA will provide practical tips and advice on how to issue valid payment notices and what pitfalls to avoid. HKA will also look at matters to consider when pursuing outstanding payments on the basis that no valid payment notices have been issued.

Speakers
John Jones is a Chartered Quantity Surveyor who started his career working in the commercial team of a major UK contractor. Subsequently, he has studied for a Master of Laws degree in Construction Law and Arbitration and now specialises in dispute resolution, claims preparation, adjudication services and as Expert Witness providing quantum reports for litigation and arbitration.

Andrew Willis is a Quantity Surveyor with extensive experience gained within the civil engineering, building and power generation industries working with major UK contractors. He holds a Master’s degree in Construction Law and acts for both referring and responding parties, providing expert opinion on quantum issues.
