As construction projects continue to be impacted by the pandemic, HKA and Crown Office Chambers are delighted to be hosting this ‘in-person’ event, with speakers discussing Covid related claims and disputes arising from supply chain issues. The presentations will consider the contractual and legal issues that arise, as well as the technical aspects of evidencing claims.

ISABEL HITCHING QC

Isabel is a specialist in commercial, construction and engineering, and related insurance, professional negligence and property damage fields.

Isabel is known for combining intellectual rigour with a team working and commercial approach, identifying an effective strategy to achieve the best for her clients whether at trial or in mediation and negotiation.
Isabel undertakes frequent trial work in the High Court and is regularly instructed in adjudications and arbitrations. She is known for her ability to analyse and marshal vast disclosure and work effectively with multi-disciplinary teams of experts.

Prior to taking silk Isabel was the most senior commercial/construction specialist on the Attorney General’s panel and acted for the government in a large number of high value (up to £300m), factually complex and politically sensitive disputes. Isabel continues to act for the government as Queen’s Counsel as well as for insurers and private clients.

Isabel is also instructed as both an arbitrator and an adjudicator in insurance, commercial and construction matters.

Patrick specialises in construction, professional negligence, insurance and commercial disputes. Much of his work is in the High Court (particularly the TCC) and he has also appeared before the Court of Appeal. Patrick deals with the wide range of claims that arise in the context of construction and engineering disputes. His experience ranges from residential disputes to major international projects. He is comfortable dealing with the standard forms of contract as well as bespoke agreements. He is instructed by employers, contractors and subcontractors. Alongside his court and arbitral practice, Patrick is frequently instructed in relation to adjudications. He provides strategic advice on complex linked adjudications as well as effective drafting in a wide variety of disputes.

MICHELLE METZ

Michelle is a planner by training and has over 28 years of experience in the construction industry. She has worked on a wide range of projects, acted as delay expert on 14 occasions and expert assistant on a further 13 disputes.Michelle has acted as expert, or assistant expert, on complex disputes for projects with values in excess of US$250 million. She has experience as a party appointed delay expert and has given oral evidence to an arbitral tribunal in Hong Kong.

She is able to draw on her strong planning background to both assist and advise clients on matters of delay to construction and engineering projects. Michelle also provides advice on the preparation of time related claims, master programmes, associated updates and reviews, the management of time risks and extension of time assessments.

Michelle’s site planning experience includes major highways, complex rail and high-rise tower block projects and commercial fit-outs across Asia, Europe and the UK.

DAMIAN WATERS

Damian is a legally qualified quantity surveyor with over 35 years of construction industry experience. He has worked on a broad range of projects for a varied UK and international client base in the building, civil engineering, infrastructure, oil and gas, power and utilities, marine and off shore renewable sectors. Damian has provided commercial and contractual advice to contractors and employers on a number of major international projects and has significant experience in managing large multi- disciplinary teams both in pursuing and defending construction claims. He has strong commercial and contractual knowledge and has worked with a range of standard forms of contract, including JCT, NEC3, FIDIC, GC Works, IChemE, ICE, PW/CF, RIAI and various bespoke forms of contract.

Damian has acted as an Expert Witness and Expert Advisor on quantum matters on numerous occasions.
