What we did
HKA was retained by counsel on behalf of the owner of an oil refinery in South America to rebut claims in excess of US$50 million brought by the civil contractor. The claims for increased costs related to purported delay and disruption caused by late design information during the refinery expansion project.
HKA authored two-200 plus page reports and testified on schedule delay and damages issues at the ICC arbitration proceedings.
Outcome
The tribunal awarded the civil contractor only US$10.8 million of its US$50 million claim, not including prejudgment interest.
