International Construction Law Conference 2020

On Thursday, 10 September 2020, the King’s College London Centre of Construction Law and Dispute Resolution, and the Academy of Experts, virtually hosted the International Construction Law Conference. 

The conference united the foremost international construction law practitioners from 24 leading law firms, chambers and expert consultancies, along with a number of senior in-house lawyers and industry experts.  The conference was ‘attended’ by over 3,500 delegates who were provided with a series of interesting and topical sessions on aspects of construction law and dispute resolution.

The keynote speech was provided by Mrs Justice Finola O’Farrell DBE, Judge in Charge of the Technology and Construction Court and member of The Academy of Experts Judicial Committee. You can access the recordings here.

Derek Nelson, HKA Partner and Chairman of The Academy Experts participated in the session on Advanced technologies and the role of the expert chaired by Vivek Kapoor, Barrister, 39 Essex Chambers. Access the recording here.

Derek Nelson said: “From manual calculation of CPM programmes to 3D scanning of entire projects overlaid onto 7D BIM models with augmented reality in one [not nearly finished yet] working life, things have changed and are changing at pace. The role and responsibility of the expert remains constant with courts [and tribunals] becoming more vocal in their condemnation of experts that fail to perform that role and obligation. The session addressed some of those challenges. I am grateful to both Vivek Kapoor and Ashilee Schreiber for their thoughts and insights.”

The future of construction in KSA

HKA was a proud sponsor of the Leaders in Construction KSA Summit 2020, and was pleased to take part in one of the panel discussions, “The Future of Construction in KSA”.

The panel looked at how Saudi Arabia’s infrastructure sector is adapting with the changing marketplace by welcoming all genders, ages, and nationalities with no division to projects (recorded 30 September 2020).

Expert evidence in a virtual era

Introduction

With over 3.2 billion people [some 40% of the world’s population!] on forced lockdown across the world as a result of the COVID-19 pandemic, all dispute resolution fora are having to find a new way of operating.

Courts are adapting their procedures to accommodate a degree of business ‘as close to’ normal as possible.

Whilst some parties/dispute resolvers are seeking to adjourn proceedings, that is not always possible or desirable and there is no clear understanding as to how long the current restrictions and international travel restrictions will last.

Courts and Arbitrations have accommodated remote participation of witnesses at hearings where it is impossible or impractical for that participant to appear in-person. Much of the procedural business of, e.g. an international arbitration, can and is routinely dealt with through various virtual platforms. Whilst such elements are reasonably familiar to experts and counsel, what is not common is the hosting of ‘virtual hearings’ for all participants. Beyond the hearing, members of the same legal team, their clients and witnesses may be separated from each other because of self-isolating or social distancing directions from national governments, increasing the reliance on technology and its collaborative potential to bridge that physical separation.

Remote working has become the new normal for most businesses seeking to continue operations during this time.

Panel Discussion Webinar

The Academy of Experts and HKA had a panel discussion webinar on 13 May 2020 that sought to share experience and opinions on the giving of expert evidence in ‘virtual hearings’, in any dispute forum, and address questions connected with the ‘new normal’.

The webinar was introduced by Derek Nelson and moderated by Professor John Uff CBE QC, Vice President, The Academy of Experts.
