Patrick Jensen

Patrick Jensen is an economic damages, forensic accounting, and quantum expert with 20 years of experience in various industries, including government contracts, energy and utilities, defense, and construction industries, as well as other commercial entities.

Patrick has provided expert testimony on financial, cost, economic, and damages analyses. Since 2005, he has worked for both plaintiffs and defendants on domestic and international matters in dispute in various venues, including US federal, state, and local courts, US Boards of Contract Appeals, and in arbitration and mediation. He has particular experience in the nuclear power industry, where he has consulted on matters involving breach of contract allegations, with implications for additional incurred and projected costs, damages, and schedule impact considerations.

Patrick has consulted on construction projects in various industries, including residential, commercial office, federal government, military test facility, museum, mass transit rail, highway, and power plant projects, some of which have involved consideration of US federal public contract regulations due to federal funding.  He has assisted in-house and outside counsel for corporations and government organizations.

Patrick’s expertise covers a broad range of disputed matters. He  evaluates lost sales and profits allegations as part of intellectual property and lost profit claims, including alleged trademark use, trade secret theft, use of proprietary business competitive information, and copyright infringement. He has been retained as an expert in construction and property disputes relating to the assessment and quantification of costs, including increased costs, design-build issues, and breaches of contract, and has analyzed delay, disruption, and productivity issues.  He also provides consulting services to government contractors on a variety of issues and disputes, including breach of contract, equitable adjustment (REAs), procurement, False Claims Act (FCA) actions, Price Reduction Clause and Defective Pricing considerations, mischarging and improper billings to the government, US Government contracting compliance (Federal Acquisition Regulation Part 31 Cost Principals), audits from the United States Government (DCAA) and the Department of Health and Human Services Office of the Inspector General, the Truth in Negotiations Act (Truthful Cost or Pricing Data).

Patrick holds a degree in finance and business economics and is a Certified Public Accountant, a Certified Fraud Examiner, a Certified Valuation Analyst, and a Master Analyst in Financial Forensics. He is a member of the AICPA, a member of, the Association of Certified Fraud Examiners, the Board of Contract Appeals Bar Association (former co-treasurer), the Energy Bar Association, the National Association of Certified Valuators and Analysts, and the Virginia Society of Certified Public Accountants.

Greg Bingham

Greg Bingham is a forensic accounting and quantum expert with over 36 years of experience in the field of business consulting, primarily for Government and Construction Contractors.

Greg Bingham is an accomplished practitioner with over three decades of experience providing expert testimony in high-value government contract disputes involving damages, loss of profits and delay claims.

Clients have included corporations, partnerships and individuals; in-house and outside counsel.  Greg has consulted with contractors to the U.S. government, including contractors to many different departments – Defense, Energy, State, Housing & Urban Development – as well as the National Aeronautics and Space Administration, Army Corp of Engineers, Department of Veterans Affairs, Agency for International Development, the General Services Administration, National Institute of Health and others. Greg’s assistance to clients has included presenting his findings in settlement negotiations, alternate dispute resolution proceedings, depositions and trials.

Greg is a highly experienced expert with over 100 commissions. He has testified in litigations over 40 times, twice in arbitrations, delivered 25 depositions, and has given concurrent evidence (hot-tubbing). He has acted as an expert in disputes up to US$2 billion on projects valued in excess of US$15 billion. Greg has testified on numerous types of dispute issues, including damages, penalties and industry practices relating to disputes arising from government contracts and subcontracts, such as contract breaches, lost profits, termination cost recovery and recovery of the costs of delay and disruption.

Greg has worked on commissions throughout Europe, the Middle East, North and South America. He has experience in a variety of client sectors, including buildings, defense, industrial, infrastructure, oil and gas, power and utilities, and technology.

Greg has assisted clients with a multitude of issues arising from disputes, including forensic investigation of issues involving accounting, estimating and billing including allegations of defective pricing, false claims, mischarges, improper labor charging and improper billings. He has reviewed and prepared hundreds of claims for changed work, delay and disruption, as well as over 1,000 termination settlement proposals on contracts terminated for convenience as well as assistance on contracts terminated for default. Greg has also consulted on compliance issues arising from the contract pricing and evaluation guidance found in FAR Parts 12 and 15, as well as compliance with the Cost Principles found in FAR 31 and the Cost Accounting Standards.  Greg has assisted in the initial preparation and updates of CAS disclosure statements as well as the assessment and quantification of cost impacts caused by changes to disclosed or established cost accounting practices. Further to this, Greg assists with Federal Supply Schedule issues relating to the triggering of the Price Reductions and Defective Pricing clauses, and analysis of cost realism and other cost and price evaluation issues on bid protests.

Greg holds a BS Electrical Engineering and an MBA. He is a member of Government Contracts Advisory Board at George Washington University. Greg is chair of the Contract Finance Committee for the National Defense Industrial Association. He is also an associate member of the Public Contract Section and the vice-chair of the Accounting, Cost & Pricing and Contract Claims & Disputes committees of the Pubic Contract Section of the American Bar Association (ABA). He is a member of the National Contracts Management Association.

Julia Alcarez

Julia Alcarez is a Certified Public Accountant, a Certified Fraud Examiner, and a Certified Management Accountant. She specializes in the investigation and resolution of business disputes, primarily related to government contracts and commercial litigation, and in engagements that require extensive data analysis.

Julia has assisted in calculating and evaluating damages claims ranging from tens of thousands of dollars to over $1 billion, with clients ranging from small, locally owned businesses to defense contractors, municipalities, and Fortune 500 companies.

Julia has provided litigation support for engagements that focus on cost, schedule, and damages analyses, as well as other dispute and compliance related issues, often within the context of the Federal Acquisition Regulation (“FAR”) and the Defense Contract Audit Agency’s (“DCAA”) Contract Audit Manual (“CAM”). She has performed extensive data manipulation and analysis to identify potential fraud, alleged mischarging, and business trends.

Julia has assisted in preparing certified claims, Requests for Equitable Adjustment (“REAs”), and Termination Settlement Proposals (“TSPs”) for prime contractors and subcontractors, as well as analyzing and rebutting DCAA audit reports and government positions. She has also participated in many bid protests, including analyzing cost and pricing issues for intervenors and protestors, preparing affirmative declarations, and rebutting opposing experts’ declarations.
