The Academy of Experts and HKA publishes new research on expert witness process

The Academy of Experts (TAE) in conjunction with HKA as its largest Corporate Provider of Expert Services, has published a new research report, An Expert’s Perspective, examining the experiences of expert witnesses and expert assistants involved in litigation, arbitration, and other dispute resolution proceedings.

An Expert’s Perspective 2026 report provides an expert-led view of how expert evidence is commissioned, prepared, and presented in dispute resolution proceedings.

Drawing on responses from 456 experts and expert assistants across a range of jurisdictions and disciplines, the report explores key stages of the expert process, including appointments, instructions, disclosure, report preparation, expert meetings, witness conferencing, the use of expert assistants, and the emerging role of artificial intelligence (AI).

While the role and performance of expert witnesses is frequently discussed by judges, arbitrators, lawyers, and commentators, comparatively little research has focused on the experiences of experts themselves. The report seeks to address that gap by providing an expert-led perspective on a number of recurring themes arising in contemporary dispute resolution practice.

The research is intended to contribute to the ongoing discussion about how experts, lawyers, parties, and tribunals can work together to support independent, transparent, and effective expert evidence and, ultimately, the fair administration of justice.
