David Tenenbaum has over 25 years of experience in economic and financial assessment of intellectual property and other intangible assets. He has supported testifying experts and client legal teams on numerous high-stakes disputes.
David has led litigation engagements involving patent, trademark, copyright, and trade secret matters. He has formulated and built complex damage quantification models, drafted expert reports and rebuttals of opposing expert reports, and supported expert witnesses for deposition and trial testimony.
David’s expertise includes damages-related discovery planning and execution, accounting and financial analyses for assessing liability and damages issues, and evaluation of settlement positions and offers. He has supported clients in the valuation of IP and other intangible assets in a variety of transactions, including licensing, mergers and acquisitions, divestitures, joint ventures, bankruptcy and reorganization.
Background
David has completed over 200 client assignments in litigation, transactional, tax, and insurance-backed lending settings. In tax planning and controversy contexts, David has conducted numerous valuation studies and authored reports to support clients’ compliance for related-party transactions involving IP rights, marketing intangibles, and professional services. He held a senior position at a leading insurance broker in connection with an IP-backed lending offering, overseeing a team that analyzed the risk profile and economic value of borrowers’ proposed IP collateral to assist carriers in their underwriting.
David holds a degree in industrial engineering and a master’s of management with concentrations in finance and marketing. He is a longstanding contributor to the International Trademark Association, where he has served on several key committees and spoken at major conferences. David served as an advisory council member of the Master of IP Management and Markets program at the IIT Chicago Kent College of Law. He has also published thought leadership articles and presented to professional groups on IP valuation, financial reporting and tax aspects of IP-rich transactions, and economic damages in IP litigation.
