Former Chief Justice of the Federal Court of Australia, The Honourable James Allsop AC, features as the guest speaker in what will be a fascinating keynote address. He will address “Continental Federalism and Arbitration in Australia: A weakness or a strength?”
This topic will cover Australia’s federated structure and large size in the ‘bottom corner’ present difficulties for visualising Australia as a seat. Also, without such a thing as ‘Australian law’, an Australian choice of law clause means a State or Territory choice of law clause. With six States and two Territories and different and distinct legal professions and judiciaries spread across a continent, how can Australia be seen as a centre for international arbitration as opposed to a place where there are various centres? Perhaps, however, apparent weaknesses are indeed strengths.
