The panel will address the immediate impacts of COVID-19, including delays, disruption, and scaling back on investments. The session will explore the problems and concerns that owners and contractors are facing during the crisis and cover the range of contractual/legal rights and remedies open to them, before looking at what we might see in the foreseeable future.

Discussion will include the following issues:

Panellists:

Colin Johnson, Partner, HKA – Colin has international experience in analysing, negotiating, and managing major energy projects and has worked in Europe, North America, Latin America, Africa, the Middle East, and Asia. Recognised by Who’s Who Legal as a Global Leader, Colin has acted on behalf of national governments, large companies, and entrepreneurs in international arbitrations and litigation as an expert witness for a variety of cases ranging up to US$50bn+ in claim value.

Michelle Metz, Partner, HKA – Michelle is a planner by training and has over 28 years of experience in the construction industry. She has worked on a wide range of projects, acted as delay expert on 14 occasions and expert assistant on a further 13 disputes. This experience has been gained on a range of projects including the construction of pharmaceutical facilities, LNG refineries, combined cycle power plants, rolling stock, roads, rail, tunnelling, airports and building projects.  She has experience as a party appointed delay expert and has given oral evidence to an arbitral tribunal in Hong Kong.

Caroline Pope, Partner, DLA Piper – Caroline has over 30 years’ experience in litigation, arbitration, adjudication and ADR processes particularly mediation and expert determination. She spends a considerable amount of time providing clients with project advisory and forensic investigation work to help clients avoid the issues arising during projects developing into full scale formal proceedings. Caroline acts for clients from all sides of the engineering and construction industry, principally in complex technical engineering disputes. She previously spent two and a half years in the Middle East where she established a solid construction and engineering practice in the region.

David Moss, Consultant, DLA Piper – David has 30 years’ experience providing legal advice to national governments, funders, developers, employers, contractors, specialist contractors and design teams. He advises on the legal contract administration of infrastructure projects, including the resolution of formal disputes. He has advised on many forms of standard and non-standard contracts and was involved in demonstration projects using the ECC (the predecessor to the NEC). He sits as an adjudicator, mediator and a member of Dispute Review Boards.
