Introduction

Twenty-five years after its first publication, the NEC contract continues to spark debate regarding the contractual interpretation of key clauses. In this interactive seminar, consultants from HKA will assume the role of contractor, subcontractor, and project manager in four scenarios based around actual disputes. They will debate some of the intricacies and subtleties within the provisions of the contract in respect of:

  1. Assessing compensation events – forecast versus actual cost assessment
  2. The Accepted Programme – who benefits when it is out of date?
  3. Mitigation/acceleration – what to do… and when
  4. Assessing delay under NEC4 – the impact of the new ‘dividing date’

About the Speakers

John Jones is a chartered quantity surveyor with a masters degree in Construction Law and Arbitration. He specialises in dispute resolution, claims preparation, adjudication services and as expert witness providing quantum reports for litigation and arbitration.

Andrew Willis is a chartered quantity surveyor with experience gained within the civil engineering, building and power generation industries. He holds a masters degree in Construction Law and acts for both referring and responding parties, providing expert opinion on quantum issues.
