The duties of a claims consultant as an expert witness continue to come under increasing scrutiny by the courts, and now include clarified obligations of loyalty and the avoidance of conflict of interest. A failure to appreciate these can have serious financial and reputational repercussions for the consultant, as well as instructing counsel whose ability to adequately present their case before a court or a tribunal may be compromised.
