OVERVIEW

The successful management of compensation events under NEC is fundamental to the effective operation of the contract. One of NEC’s perceived strengths is that it actively promotes the use of prospective quotation assessments with a view of providing the Employer with time and cost certainty, often before the actual costs may be known or before the changed works have been carried out.

However, frequently in practice and in our experience of dispute resolution proceedings, the parties’ failures to strictly adhere to the prescribed timescales of NEC, or a fundamental misunderstanding of the provisions themselves, often leads to conflict.

In view of the above, our seminar will consider some of the issues surrounding compensation events:

  • notifying and presenting early warnings and compensation events
  • assessing defined costs
  • valuation of compensation events using the ‘dividing line’
  • revision of compensation event quotations when forecasts later turn out to be wrong
  • assessing delay to completion

During the seminar we will also review some of the recent changes brought about by NEC4. Described as an evolution not a revolution, the amendments to certain clauses will result in a significant effect on the assessment of compensation events.

SPEAKERS

John Jones is a Chartered Quantity Surveyor with a Master of Laws degree in Construction Law and Arbitration and now specialises in dispute resolution, claims preparation, adjudication services and as Expert Witness providing quantum reports for litigation and arbitration.

Andrew Willis is a Chartered Quantity Surveyor with extensive experience gained within the civil engineering, building and power generation industries. He holds a Masters degree in Construction Law and acts for both referring and responding parties, providing expert opinion on quantum issues.
