The not-for-profit AAA is the world’s leading source of alternative dispute resolution (ADR) services for parties in commercial disputes. With offices in the United States, Mexico, Singapore, and Bahrain, the AAA provides neutrals, advocates, counsel, and other professionals with a wide spectrum of education and training events and resources.

This year’s conference, “Effectively Preventing, Managing, and Presenting Construction Disputes in the Age of the ‘New Normal’”, focuses on the growing complexities of construction projects, preventing the often-inevitable disputes that arise in these projects, and developing dispute resolution strategies to mitigate risk and keep projects moving forward.

A Breakfast with General Counsel kicks off the day-long conference with a discussion of current issues important to construction companies. HKA Partner Lorna Cuthbertson Tardif, along with John R. Dingess, DFL|LEGAL; Paul A. Varela, Varela, Lee, Metz & Guarino, LLP; and Wm Cary Wright, Carlton Fields, will be delivering a presentation on Key Issues in Presenting Disruption and Delay Cases. Thomas M. Ventrone, Vice President, International Centre for Dispute Resolution®, will serve as the session moderator. Additional sessions include:

  • Discovery Best Practices for Construction Arbitration
  • Consolidation and Joinder in Construction Disputes
  • Challenges, Cultural Differences, and Conflict Management Options for International Disputes
  • Ethics in Arbitration

HKA’s Ed Federico, Peter Vosbikian, Lefty Silvera, and Tracy Doyle will also be attending the conference.

Attendees will learn techniques and best practices that can help them adapt their dispute resolution strategies for complex construction projects in today’s “new normal.”

Lorna Cuthbertson Tardif, Partner

Lorna Cuthbertson Tardif is a registered professional engineer with more than 35 years of experience in expert testimony, claims consultancy, dispute resolution and project advisory services across the construction industry. She was recognized by Who’s Who Legal in 2021 as a leader among Canada’s Arbitration Expert Witnesses.

Lorna has been retained as an independent expert on more than 200 occasions by owners, contractors, design professionals, and financial institutions. She has sat as an arbitrator, mediated the resolution of construction disputes, and given expert witness testimony before courts and arbitration panels in both Canada and the United States on disputes valued up to several hundred million dollars.

With a strong focus on effective project controls, Lorna has made innovative use of data extraction technology and data analytics in her work. Her expertise lies in delay analysis, analysis of labor productivity and quantification of damages on large, complex construction projects. Lorna has led multi-disciplinary teams on many projects valued at more than a billion dollars in the energy, industrial, and infrastructure sectors.

Prior to entering the claims resolution business, Lorna held on-site positions for general contractors on large energy and infrastructure projects across Canada and was the project manager on a complex tunneling project in a major urban area. She also founded and managed an independent advisory firm for 25 years, providing project management and construction claims services to both Canadian and international clients.
