Causation, Disruption and Risks to Entitlement

Join us at this in-person breakfast event on the topics of causation, disruption, and risks to entitlement when HKA Principal Russell Bates will explore the difficult area of causation that can give rise to significant disagreement between the Parties and their respective experts. 

Senior Consultant Ryan Bennett will then discuss the application of a measured mile disruption analysis and challenges of records, linking cause and effect, and separating Employer and Contractor risk events.

Followed by Lucy Preston of Orrick, Herrington & Sutcliffe LLP who will consider ‘How NOT to make a disruption claim’ and what makes a successful or unsuccessful claim for disruption, together with specific issues arising from the main standard forms of contract.

Russell is a renowned delay expert specialising in project planning, critical path methods of delay analysis and delay and disruption, with over 30 years of experience in the construction and engineering industries.

Ryan Bennett – Senior Consultant – HKA
Ryan is a senior consultant with over 10 years of construction industry experience and knowledge in the preparation of claims, adjudication proceedings and the provision of expert reports for international arbitration.

Lucy Preston – Managing Associate International Arbitration – Orrick
Lucy practices international commercial dispute resolution, primarily in the construction, energy, infrastructure, aviation and projects sectors, and regularly works with the major arbitral institutions (ICC, LCIA, SIAC) as well as in the English courts.
