HKA is pleased to invite you to join our panel discussion organised as part of CMS’ 2nd Annual Asia Pacific Construction Law Conference 2022.

In this session, our panellists discuss and address the myriad of legal, delay, quantum and commercial damages issues that arise in a typical construction project impacted by the COVID-19 pandemic. By way of a case study, our panellists consider the technical and legal factors relevant to assessing the impacts of the pandemic, and discuss topical issues such as identifying the effect of project suspension on pre-COVID and continuing delays, and how to address loss of productivity issues during remobilisation post-suspension.
 
This will be a practical session that looks at providing useful tips and guidance for industry actors to address topical challenges in contract and project administration.

Panellists

Hamish Egan
Associate Director, Forensic Accounting & Commercial Damages, HKA

Hamish Egan is a Chartered Accountant and a Chartered Financial Analyst (CFA) Charterholder with more than 15 years of experience including forensic accounting, business valuation, audit and corporate finance.

Hamish specialises in forensic accounting on complex contentious matters and has been appointed as an expert forensic accounting witness, acting as an expert on a matter with disputed values of up to US$125 million. He has worked across multiple forums ranging from international arbitration and court litigation, to mediation.

Based in Singapore for almost a decade, Hamish’s forensic accounting experience includes business valuations, arising from shareholder, M&A and post-acquisition disputes; estimation of loss of profits, arising from alleged breaches of contracts, agreements and insured events; and the analysis of complex accounting information.

Hamish has worked across various sectors including oil and gas, energy, mining, financial services, manufacturing, food, and services; with clients or assets in jurisdictions across Asia including Singapore, Malaysia, Indonesia, Philippines, China, Vietnam and Thailand. He also worked for the sovereign wealth fund of Singapore, where he was involved in developing the firm-wide valuation policy and reviewing the valuations of private equity investments.

Hamish holds a degree in economics and finance and a diploma in accounting. He is a member of the CFA Institute and the CFA Society of Singapore as well as the Chartered Accountants Australia & New Zealand.

Scott Ramsden
Quantum Expert, Principal and Head of Operations Hong Kong, HKA

Scott Ramsden is a quantity surveyor and construction professional with over 30 years of experience. He has acted as a quantum expert and assistant to the named expert on multiple occasions.

Scott has been cross-examined as a witness in mediation and arbitration proceedings. He has been appointed as an independent quantum expert in arbitral proceedings relating to offshore oil and gas, with disputed values of US$250 million. He has also acted as lead assistant for offshore oil and gas, power and infrastructure project disputes.

Scott has over 20 years of international experience, including 15 years working in the Middle East and Asia, as both a contractor and consultant. He has provided commercial management services to major international contractors and oil and gas companies and supports client with wide ranging strategic advice.

Scott’s sector expertise includes ports, mining, oil and gas, infrastructure, airports, buildings, power, and industrial projects. He has considerable experience in the preparation, defence, negotiation and settlement of contractual claims, and supports solicitors and barristers regarding commercial and contract management matters and dispute resolution services.

Scott is a fellow of the Chartered Institute of Arbitrators and an associate member of the Chartered Institution of Civil Engineering Surveyors. He holds a master’s in construction law and arbitration and a diploma in quantity surveying.

Stephen Wright
Associate Director, HKA

Stephen Wright is a planning professional with over 25 years of industry experience. He has been appointed as a delay expert six times and has assisted the named expert on numerous occasions.

Stephen has provided oral testimony in both arbitration and dispute board hearings on time related matters. He has acted as an expert for disputed values of up to $100 million and for project values of up to $350 million.

Stephen has a background in project management related disciplines on airports, commercial developments, civil engineering projects, hospitals, and power and process plants. He specialises in the use of Primavera Project Planner and Artemis and is well versed with Microsoft Project, Power Project and standalone programme review and risk software.

Stephen’s expertise includes the analysis, review and preparation of extension of time claims and retrospective delay analysis on a wide variety of projects throughout Europe, the Middle East, Asia and Australia. His analytical programming skills and diverse live project experience enable him to efficiently identity the cause of problems and their effect on the programme.

Stephen is a practising associate of the Academy of Experts and has completed their expert witness training and accreditation programme. He has undertaken various speaking engagements regarding delay analysis and the critical path method.
